Copycat!

Jay-Z, a multi-platinum rapper and devoted Yankees fan, and his business partner filed a lawsuit on Thursday against the hated Boston Red Sox “star” David Ortiz.  The recording artist claims that “Big Papi” bit off the 40/40 brand by naming his own nightclub in the Dominican Republic “Forty-Forty.”

Jay-Z and Juan Perez own 40/40 Clubs in New York City, Atlantic City and Las Vegas and have plans to open further venues in Tokyo and Macau.  They challenge that Ortiz is using the “fame, value and goodwill of their name” which has caused their business “marketplace confusion and damage.”

The suit seeks over $5 million in damages and for Ortiz to forfeit any use of the 40/40 name.

According to the 40/40 Club website, Jay-Z picked the name for his club because “the 40/40 club in baseball is as exclusive as it gets.” But as Fanhouse’s Tom Fornelli points out, Ortiz has never had a 40 homer, 40 steal season so it doesn’t make sense for him to rip off the name.

There have been no comments from the David Ortiz camp thus far, but the Yankees-Red Sox rivalry just escalated to a whole new level.
